A young man got angry when his mother-in-law was assaulted by a teenage gang in a restaurant, so he came with a pistol and fired into the air. Together with his friend, plus the two ladies, they left in a pickup truck went through an intercept barrier and were finally chased and arrested by police.

PATTAYA – October 30th, 2013 [PDN]; – At 4.20am. while Police Major Seksan Reuvate, (the Inspector of Pattaya City Police Station) in Chonburi Province,) together with Police Captain Vitsanu Chaisuwan, (the Deputy Inspector), mobilized units of police to inspect a crime in South Pattaya. They were notified that there was an incident involving shooting in a 10–Baht curry and rice restaurant at Nong Plamor T-Junction, near the red light crossing of Sophon market in South Pattaya, so the police rushed to inspect the crime scene.

When police arrived at the 10–Baht curry and rice restaurant, the police didn’t find the teenagers gang that made trouble, because they already escaped and the witnesses at the incident scene informed the police that there was a gang of almost 10-male teenagers, who had assaulted two Thai women. The ladies had because they attempted to order food and the teenagers attempted to ‘queue jump,’ so an argument had started and the two women were assaulted. They called a young Thai man to assist them and he took out a pistol then fired into the air once to scare the teenage gang, so they fled from the incident scene. Then the young man together with his friend assisted the two women to escape a black pickup truck; (Isuzu ‘Dmax’ license number PHOR YOR-205 Chonburi) and they drove away from near the market at Chaimongkhol temple. After getting initial information the police coordinated with the inspection team and volunteer police to intercept and arrest the young Thai man, who had used the pistol and was in the pickup truck trying to escape the scene.

When he saw the police they didn’t stop the pickup truck, but drove from the market at Chaimongkhol temple and directly to the Marine hotel along Pratamnak Hill Road, so the police team chased them until could arrest them at the red light crossing on the large intersection with Thepprasit Road. The police restrained all of the occupants; (consisting of 2-men and 2-women), then bodily searched them to find illegal items which were a 9mm. Chinese ‘Norinco’ pistol and one cartridge in a gun bag within the compartment of the driver’s seat, so the police impounded these.

Investigations showed that 22- years old Mr. Thaweesak Porncharoen or “Bu” of 219 Moo-13 Tambon Baanchuan, in Amphur Bamnejnarong of Chaiyaphoom Province, was one of four persons in the pickup truck. He confessed that he took the gun to fire into the air, because he wanted to assist 41-years old Mrs. Kallaya Raksap, who is his mother-in-law and 37-year old M/s. Arisa Charnkhoonthod, who is his ‘tomboy’ friend. He stated they although they were assaulted by the gang of male teenagers in the 10-Baht curry and rice restaurant, he didn’t intend to shoot anyone but he only fired into the air to scare the gang of teenagers away for assaulting his mother-in-law and his tomboy friend.

Mrs. Kallaya (the victim) attested that before incident occurred she and M/s. Arisa (her ‘tomboy’ friend) were working in the snooker room at a pub and when they finished work they drove the motorbike to buy food at the restaurant. However, during when ordering the curry there was a gang of male teenagers (the litigants), who tried to jump the queue and pushed over a glass cabinet of the restaurant, causing pieces of glass to cut both Mrs. Kallaya’s and M/s. Arisa’s hands but the criminal teenagers didn’t apologize to them. During an argument and quarrelling the gang of teenagers assaulted them so Mrs. Kallaya hurriedly called both Mr. Thaweesak Porncharoen, who is her son-in-law and also her nephew to bring the pistol, which is the inheritance of her father who was an ex-policeman. She had inherited the pistol after her father had died and decided that it was needed to assist her and her ‘tomboy’ friend. When her son-in-law arrived at the scene he was carrying the gun and got out from the pickup truck and fired into the air to scare the gang of male teenagers, so the teenager gang all escaped separately. After that the men, plus the two ladies drove the pickup truck from the scene but they were finally intercepted and arrested by the police.

Mrs. Kallaya (the mother-in-law of Mr. Thaweesak), then hurried to bring the documents of ‘permission to have a gun’ to confirm that this gun is the heritage from her dead father, who was an ex-policeman and that he died in 2010. After the police inspected these documents, they found that the gun was not transferred as a right of heritage or that the ownership name had not changed from the name of the former owner, who was her dead father. However it was correct that he was an ex-policeman and that the name of Mrs. Kallaya as his daughter was correct. Therefore, the police informed her that the gun that is in the possession of the wrong owner, so the police restrained all of 4-people at Pattaya City Police Station in order to investigate further.

Initially, the police charged Mr. Thaweesak, (the son-in-law of Mrs. Kallaya), only with the allegation of having a gun and cartridge and both carrying plus using it in a public place without permission and shooting in a public place without permission, so they will prosecute him further according to Thai law. Whilst it is clear that the defendant had every right to be annoyed by his ‘mother-in-law ‘ being assaulted, it would have been wiser to ask for police assistance at this point, as it was the teenage gang who were the cause of this incident.

What the hell is the point of having a gun if you can't even divert trouble from happening without being punished yourself
