Not planning any dirty deeds, but this old link about an American that was possibly murdered (Thai bride inheriting the property I think)

Got me to wondering if an expat could actually own land if he and his lady were on deed and she expired.

 

30 inches of snow in farangland, too much time on my hands.

 

Any thoughts?

Not sure of the gist so guessing.

 

If you're legally married and you can show contribution (?) but beware of proxy RULES, then it might pass to you or maybe only 50% to you and 50% to her family, who will have moved in.

 

Either way, you can't own it but I think you have one year to sell it. Since the family will be in residence, marketing opportunities will be limited - to them.

 

In reality, I suspect you'd be stuffed, despite the many and various pieces of paper people may recommend, including Leases, Usufructs and Wills.

Your investment would pass away with your true love I reckon.

You cannot own the land the house is built on.

You may own the property but the land will need to have been leased to you. Unlikely to happen since your beloved will have told you "Not worry my family love you"

 

If she owns the land and agrees to give you a 15 year lease, better x 2 so 30 years? Check with solicitor that the lease does not become void in the event of her death and Thai inheiritency RULES mean her family have title?

 

They have title then they can stop you trespassing on their land. i.e. you cannot leave YOUR house or you cannot cross their land to go in??

 

It is unlikely you would buy/build anything in your own country under Thai laws/rules. Why so many people do so amaze me.

 

Me, I am lucky since my TGF is different and everything will be good.

That is true. Thai inheritance laws rate a husband after the family Soi Dog.

 

Get the wife to make a will leaving it all to you and then get a usufruct(like a more powerful lease) prepared and that will allow you to virtually own the house until you die. The land that the house sits on will have to be transfered into a Thai name, assuming its in the deceased persons name. I hear you may get up to a year to sort that out, whick in my book is way long enough to arrange a replacement!
