If a Thai applies for a UK Visa and the application is declined, does the fee still need to be paid? Or is it only payable for accepted applications?

 

This can be a lot of money if you're applying for a Settlement visa.

No it is with every application unless on a settlement application you appeal if refused. However one would need to look at the grounds for refusal then decide if you have any chance at appeal that requires a level 2 adviser.

You are suggesting that one needs a level 2 adviser to appeal a refusal, I will have to disagree with you. In the past 2 years I have appealed to settlement visa refusals for 2 friends. Both of the refusals were overturned at the appeal. If you have a good knowledge of the Immigration rules and regulations, and can pen a decent appeal letter the you can write, prepare, and submit you own appeal (or get someone else to do it for you). When first approached to appeal the first refusal I did some research with regards to fee's, I found that although the Immigration Advisory Service is a non-profit organisation they were still quoting approximately 5000 Pounds Sterling to prepare and submit the appeal. Lawyers who specialize in Immagration matters were requesting a fee of anything between 7000 and 10000 Pounds Sterling. My fee, when both friends had the 'refused' decision overturned was a few beers.

If you are a Level 1 adviser you cannot do appeals ?

 

You should know this as you seem to know the rules ?

 

I must forward it on to a Level 2 adviser under OISC or you lose your licence understand ?

 

It is illegal under UK law to give Immigration advice unless you are registered to do so or a solicitor etc under Thai law you may do this.

 

Yes you may do your own appeal however i have to forward case work on that is the Law i don't make the rules i just follow them.

 

A good adviser is £1000 to do the appeal or do it yourself, we are all capable of appeals however until i become a level 2 adviser under the OISC you are not. I pass case work on to another company however this happens rarely but if it does it gets passed on.

Yes, as OISC registered you are of course correct, you (as in you personally as OISC registered) would not be able to prepare and submit an appeal, you would have to be a Level 2 advisor (although I am sure you have the knowledge to do this but by law can not). Yes I do understand. What I was referring to was, you did not make this clear (as you have done in your latest post) in the post where you stated that a Level 2 advisor would be required. For anyone reading that post the reader may be under the immprsion that they need a 'Pofessional' to prepare their appeal. I was pointing out that that is not the case.

Yes im duty bound by UK law when i work out of Thailand I do not come under the OISC umbrella so to speak. But the appeal will most likely be in the UK and i would not be able to represent anybody if i did i would lose my Level 1 status, and leave myself wide open to to sued should the appeal fail.

 

And your next question is why not get to level 2 ?

 

I am considering this but i would like a further 2 years at this level gaining further experience you find alot of advisers stick to one specialised field such as work permits etc.

 

I want to specialise in family migration EU/UK so not just yet however we use Davis Khan for level 2 work he is excellent in all aspects of difficult cases.

Anyone can prepare an appeal or a visa application with the correct knowledge of procedures and rules. Sometimes it just pays to have a professional do it for you.

You can i cannot as i said im Level 1 yes im more than capable but i operate under UK law simple.

I read and understand all the rest of your points.

 

On the above point though just to clarify, it is not illegal to give immigration or any other legal advice unless a solicitor etc. Anyone can give advice for free (unless misrepresenting themselves as qualified, but thats a diferent matter), only legally qualified persons can charge money for it.

    • For those that don't know, I did Friday meetings before many years ago,  I feel like we are missing a regular meeting for members,  I am aware guys meet at PA affiliated bars. But I want to start meeting people again, I'm inviting the guys following my YouTube also.

      The meetings is a chance to get to meet each other,  I plan to be at every meeting, I also have Dean from Dive bar that has offered to help out with a crawl after.
      The meetings will be  Monday  6 pm - 8 pm each week.  (The improvised bar crawl will commence at 8 p.m.  Dean will make his own plans for that.)

      Due to low numbers of people in town, I will start the meetings in our bars to help our girls and managers, please check back often incase things are changed.  I will be sharing the love around town later, but Soi 6 is first on my list (including bars that are friendly competition)   
      If bar owners want us to have a meeting at their bar,  they need to have a minimum of 10 girls.  I'm not dragging people to empty bars for favours.
      Please help us invite other members, it takes a while to get momentum.
