When they arrived at the incident the officers found the shop owner a Mr. Tharathorn Chomthong, aged 29, Chonburi resident, was drunk and was sitting in the driver seat of a black Mazda 3 car, license number 1 KOR KOR 2183 Bangkok that was parked in front of this liquor shop. The police asked to search him and his car where they found a revolver (pistol) size .38 brand Colt, with the calibre size 2 inches and loaded with 6 rounds of ammunition which 2 of them were already used. The revolver was hidden in a black handbag beneath the driver seat so the police kept it for evidence. While the police handcuffed Mr. Tharathorn his girlfriend and his friends were so angry they yelled loudly to blame the officers then his girlfriend tried to stop the police from arresting her boyfriend.

Upon investigating Mr. Tharathorn (the defendant) claimed that before the incident occurred he was sitting drinking alcohol with his girlfriend and his friends celebrating the opening of his new liquor shop. Suddenly there were 3 male teenagers who ran and picked up the traffic cones in front of his shop so he ran after them telling them to return them but the 3 teenagers spoke obnoxiously to look for trouble and tried to assault him so he took out his gun and fired into the air 2 times in order to protect himself which scared off the teenagers. He then put the gun into his car but was arrested by police.
