Dear Editor,

I was told today about a committee member in a Juristic Person in a well known Jomtien condominium who was recently arrested when Immigration police raided an Annual Meeting. He was arrested for not having a work permit, and he was the head of the Juristic Person.

Is this something any foreigner who serves on condo committees should be worried about? Or even people who 'run' companies which only own their houses (or condos?). I mean, what is to stop them saying you are 'working' if you are the director of a house-owning company, when you file annual company or tax returns, or even do work around the house?

For other foreigners on condo committees, this must be a worry, no? But I haven't seen it reported anywhere in Pattaya yet.

I would not be surprised as I have heard of falangs getting busted for playing in the band on an open mike night at a bar without a work permit.

 

IIRC the bar fixed the problem by charging the Falangs to play in the band, like how you have to pay to sing a Karaoke song.

 

Sounds like one more way that the whole legal fiction of creating a 'company' that does nothing but own your house for you is a bad idea.
