Teen Girl Raped In Hospital Toilet By Patient

A 15-year- old girl was forced into an Angthong hospital bathroom and raped by a 17-year-old boy. The boy was a patient recovering from a motorcycle accident. The girl was caring for her elder sister who had just given birth. He was later arrested and charged.

ANGTHONG – August 22, 2012 [PDN]: a mother reported her daughter had been raped at the Angthong hospital to Pol. Col. Anusorn Wayakam, director of Muang Angthong police station.

“Mrs. Noi” (alias), age 50, from tambon Banit Muang, Angthong, told police that her daughter was raped in the second-floor toilet of the Ratchaprapa Building at Angthong Hospital.

Mrs. Noi said that her 15-year-old-daughter, “Nam” (alias) had gone to the hospital to care for her elder sister, who had just given birth to a baby.

The sexual assault on her daughter occurred on August 19. At about 7:30 p.m., Nam went to use the toilet in the hospital. After she finished, she opened the door and found “Mr. Boy” (alias), age17, waiting outside.

Mr. Boy tried to convince her to go back into the bathroom with him. But she refused, so he forced the girl back into the toilet and raped her.

No one knew about the incident, but after she returned home, Nam looked depressed. When her mother asked why, Nam told her what happened. Mrs. Noi then came to the police.

After their investigation, police located the residence of Mr. Boy and arrested him. Mr. Boy confessed that he had raped Nam.

Mr. Boy told police he was a patient at the hospital recovering from a motorcycle accident. Then he saw Nam and talked to her. He later followed her to the toilet and then raped her.

The police held Mr. Boy and charged him with raping a woman under 15 years old who is not his wife. He was sent to be investigated in further legal proceedings.

It wasn't so long ago that rape in marriage wasn't recognised in western common law jurisidctions. It was only in 1991 that the High Court of Australia and the House of Lords ruled against the argument that marriage constitutes "irrevocable consent" to sex. Still the case in many countries. Still the case in some countries (I think you can guess which) that a woman can be forced to marry her rapist as a "resolution" (based on biblical injunctions).

 

Thailand passed a law outlawing rape in marriage in 2007, though of course in poor countries women are reluctant to complain because they are dependant on their husband. It might have been written in the article like that becasue there is a different, specific offence for rape in marriage (it carries up to 20 years, so by no means minor).

I think they meant this:

77 of The Thai Penal Code: "WHOEVER has sexual intercourse with a girl not yet over fifteen years of age and not being his own wife, whether such girl shall consent or not, shall be punished with imprisonment of four to twenty years
